Terms of Use

Please read these Terms of Service (“Terms”) carefully before using any website, event page, registration form, payment link, social media page, or other online service operated or used by Central New York Chapter #401 of the National Association of Women in Construction, Inc. (“Central New York Chapter #401,” “Chapter,” “we,” “our,” or “us”).

By accessing or using Chapter online services, registering for a Chapter event, submitting a payment, or participating in Chapter activities, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use Chapter online services or submit information or payment through them.

These Terms are intended to supplement, not replace, any terms, policies, bylaws, standing rules, or requirements maintained by NAWIC National. NAWIC National systems, including MemberSuite, the NAWIC Mobile App, national membership platforms, and other national systems, may be governed by NAWIC National’s separate terms, policies, and procedures.

Chapter Activities, Events, and Payments

The Chapter may offer meeting registrations, event registrations, sponsorship opportunities, fundraising opportunities, donations, or other Chapter-related activities through online forms, registration pages, payment links, invoices, or third-party platforms.

Fees, deadlines, event details, sponsorship benefits, refund terms, and other requirements will be listed on the applicable event page, registration form, invoice, payment link, or Chapter communication. The Chapter may correct errors, update event details, or modify availability when necessary.

Payments may be processed through third-party payment platforms. The Chapter is not responsible for the collection, use, storage, or security of payment information by third-party payment processors. By submitting payment, you represent that you are authorized to use the payment method provided and that the information submitted is accurate.

The Chapter does not offer automatic renewal or continuous service plans unless the applicable terms are clearly stated at the time of registration or payment.

Cancellations and Refunds

Unless otherwise stated on the applicable event page, sponsorship form, registration form, payment link, invoice, or Chapter communication, payments are considered final.

The Chapter may, in its discretion, allow a registration transfer, substitution, credit, refund, or other adjustment when appropriate. If the Chapter cancels or reschedules an event, the Chapter will determine the available options based on the circumstances, Chapter obligations, and any costs already incurred.

Sponsorship payments, donations, fundraising payments, and other Chapter payments may be subject to separate terms stated at the time of payment.

Prohibited Uses

You agree to use Chapter online services only for lawful purposes and in a manner consistent with these Terms, applicable law, NAWIC-related policies, and Chapter purposes.

You agree not to:
  • Misrepresent your identity or affiliation with any person or organization;
  • Submit false, misleading, or unauthorized information;
  • Use Chapter online services for spam, advertising, solicitation, or unrelated commercial purposes;
  • Interfere with the operation or security of Chapter online services;
  • Attempt to gain unauthorized access to Chapter systems, accounts, forms, data, or platforms;
  • Use automated tools to copy, scrape, monitor, or interfere with Chapter online services;
  • Upload, transmit, or introduce viruses, malware, or harmful code; or
  • Use Chapter online services in a way that violates applicable federal, state, or local law.

The Chapter may restrict or remove access to Chapter online services if it determines that these Terms have been violated or that use of the services may harm the Chapter, NAWIC, members, event attendees, sponsors, or others.

Third-Party Platforms and Links

Chapter online services may include links to or use third-party websites, registration platforms, payment processors, social media platforms, email tools, or other services. These third parties have their own terms, policies, and practices.

The Chapter does not control third-party websites or platforms and is not responsible for their content, availability, privacy practices, security practices, payment processing, or terms of use. Links to third-party websites or platforms are provided for convenience and do not imply endorsement unless expressly stated by the Chapter.

Intellectual Property

Chapter materials, including text, graphics, logos, images, event materials, forms, and other content, may be owned by the Chapter, NAWIC National, speakers, sponsors, vendors, or other third parties. Use of NAWIC names, logos, branding, or materials must comply with applicable NAWIC National requirements.

You may not copy, reproduce, distribute, modify, display, or use Chapter or NAWIC materials for unauthorized purposes without permission from the appropriate rights holder.

If you believe content used by the Chapter infringes your copyright, trademark, or other intellectual property rights, please contact the Chapter at [email protected] and identify the content at issue, your claimed rights, and your contact information.

No Warranty

Chapter online services, event information, registration pages, payment links, and related content are provided “as is” and “as available.” The Chapter makes no warranty, express or implied, that online services will be uninterrupted, error-free, secure, complete, current, or free from harmful components.

The Chapter may update, correct, remove, or revise information when necessary.

Availability, Errors, and Inaccuracies

The Chapter does not guarantee that information, event details, pricing, sponsorship benefits, registration availability, or other content will always be complete, current, or error-free.

The Chapter reserves the right to correct errors, update information, adjust availability, or revise Chapter-related content when necessary.

Limitation of Liability

To the fullest extent permitted by law, the Chapter shall not be liable for indirect, incidental, special, consequential, punitive, or similar damages arising out of or related to your use of Chapter online services, event pages, registration forms, payment links, third-party platforms, or Chapter-related content.

To the fullest extent permitted by law, the Chapter’s total liability for any claim related to a payment or transaction shall not exceed the amount actually paid by you to the Chapter for the specific event, registration, sponsorship, or transaction giving rise to the claim.

Nothing in these Terms is intended to limit liability where such limitation is not permitted by law.

Privacy

Information submitted to the Chapter is handled in accordance with the Chapter’s Privacy Policy, as applicable. Third-party platforms may have separate privacy policies and practices.

Governing Law, Severability, and Dispute Resolution

These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms, Chapter online services, or Chapter-related transactions shall be resolved in a court of competent jurisdiction in New York, unless another venue is required by law.

To the extent permitted by law, you and the Chapter agree that any claim shall be brought only in an individual capacity and not as part of a class, collective, or representative action.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in effect.

Changes to These Terms

The Chapter may update these Terms from time to time. Updates will be reflected by revising the “Last Updated” date above. Continued use of Chapter online services after updates are posted or communicated indicates acceptance of the updated Terms.
